These Terms of Service ("Terms") govern your access to and use of ScentsGift.com (the "Website") and any purchases made through the Website.

The Website is owned and operated by SWEX LLC, doing business as ScentsGift ("ScentsGift," "we," "us," or "our"), located in Texas, United States.

By accessing the Website, creating an account, or placing an order, you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies posted on the Website.

If you do not agree to these Terms, you should not use the Website or place an order.

1. Eligibility

You must be legally capable of entering into a binding agreement to make a purchase from ScentsGift.

If you are under the age of majority in your jurisdiction, you may use the Website only with the involvement and consent of a parent or legal guardian.

By placing an order, you represent that all information you provide is accurate, complete, and current.

2. About ScentsGift and Our Products

ScentsGift is an independent fragrance retailer specializing in fragrance samples, decants, and related products.

Unless expressly identified as a manufacturer-sealed retail product, fragrance samples and decants sold by ScentsGift are transferred from genuine manufacturer fragrance bottles into ScentsGift sample or travel-size containers.

Decanted products therefore generally do not include the fragrance manufacturer's original bottle, box, packaging, labeling, or accessories.

All fragrances sold by ScentsGift are represented as authentic products obtained from sources we reasonably believe to be legitimate and reliable.

3. No Brand Affiliation

Unless expressly stated otherwise, ScentsGift is not affiliated with, endorsed by, sponsored by, licensed by, or an authorized representative of the fragrance brands, designers, manufacturers, trademark owners, or fashion houses whose products appear on the Website.

Brand names, fragrance names, logos, trademarks, and other intellectual property belonging to third parties are used solely to identify and describe the genuine products being offered.

All third-party trademarks remain the property of their respective owners.

4. Product Appearance, Packaging, Formulation, and Batch Variations

Fragrance manufacturers may change formulations, ingredients, concentrations, packaging, bottle designs, labeling, coloration, presentation, or other product characteristics without notice.

Fragrances may also vary slightly between production batches, manufacturing years, storage conditions, reformulations, or geographic markets.

Such variations do not necessarily indicate that a fragrance is defective, altered, or inauthentic.

Product photographs shown on the Website are provided for identification and illustrative purposes. Packaging, labeling, color, bottle design, or other characteristics may differ from the product pictured.

5. Fragrance Perception

Fragrance perception is inherently subjective.

A fragrance may smell different depending on skin chemistry, environment, weather, application, age of the fragrance, batch, reformulation, individual sensitivity, or other factors.

Personal dislike of a fragrance, differences in perceived scent, projection, longevity, performance, strength, or similarity to a previous bottle are not considered product defects and do not qualify a product for a refund or replacement unless otherwise required by applicable law.

6. Sample and Decant Fill Levels

Sample and decant containers may have greater total capacity than the amount of fragrance purchased.

As a result, a container may not appear completely full even when it contains the quantity ordered.

Container capacity and fragrance volume are separate measurements.

The amount purchased refers to the approximate volume of fragrance dispensed into the container and not the total physical capacity of the bottle or vial.

Minor variations resulting from normal filling tolerances may occur.

7. Orders

Submitting an order constitutes an offer to purchase products from ScentsGift.

Receipt of an order confirmation does not constitute final acceptance of the order.

We reserve the right to accept, decline, place on hold, verify, or cancel an order for any lawful reason, including but not limited to:

  • Product availability;
  • Pricing or listing errors;
  • Suspected fraud;
  • Unauthorized payment activity;
  • Payment verification issues;
  • Incorrect or incomplete customer information;
  • Shipping-address concerns;
  • Quantity limitations;
  • Resale concerns;
  • Technical errors;
  • Security concerns; or
  • Circumstances that prevent us from reasonably fulfilling the order.

If we cancel an order after payment has been collected, the applicable payment will be refunded unless otherwise permitted by law.

8. Order Changes and Cancellations

Orders may begin processing shortly after they are submitted.

Because fragrance samples and decants may be individually prepared for each order, we cannot guarantee that an order can be modified or canceled after it has been placed.

Requests to change or cancel an order are reviewed at our discretion.

Submitting a cancellation request does not mean that the order has been canceled.

An order is canceled only when ScentsGift confirms the cancellation.

9. All Sales Final

Except where otherwise required by law or expressly provided in our Return and Refund Policy, all sales are final.

Due to hygiene, contamination, product-integrity, and quality-control concerns, fragrance samples and decants cannot be returned, exchanged, or refunded after fulfillment.

We cannot accept fragrance products back into inventory once they have left our control.

This includes products that:

  • A customer does not like;
  • Smell different than expected;
  • Perform differently than expected;
  • Have been previously sampled elsewhere;
  • Differ from another batch or bottle;
  • Are no longer wanted;
  • Were ordered by mistake; or
  • Were purchased as a gift and are unwanted by the recipient.

Nothing in this section limits any non-waivable consumer right available under applicable law.

10. Damaged, Leaking, Incorrect, or Defective Items

Customers should inspect their shipment promptly after delivery.

Claims involving damaged, leaking, incorrect, missing, or defective merchandise must be reported to ScentsGift within the time stated in our Return and Refund Policy.

We may require clear photographs, packaging photographs, shipping-label photographs, videos, or other reasonable evidence before approving a claim.

Failure to provide requested documentation may prevent us from verifying or approving a claim.

If we determine that an item qualifies for a remedy, ScentsGift may, at its discretion and subject to applicable law, provide:

  • A replacement item;
  • A replacement component;
  • Store credit;
  • A refund; or
  • Another reasonable resolution.

11. Shipping Addresses

Customers are responsible for providing a complete, correct, and deliverable shipping address when placing an order.

This includes any applicable:

  • Apartment number;
  • Suite number;
  • Unit number;
  • Postal code;
  • ZIP Code;
  • Company name; or
  • Other delivery information.

ScentsGift is not responsible, to the maximum extent permitted by law, for loss, delay, return, misdelivery, or additional charges resulting from incorrect, incomplete, outdated, or undeliverable address information supplied by the customer.

If a shipment is returned because of an address problem attributable to the customer, additional shipping charges may apply before reshipment.

12. Shipping and Delivery Estimates

Any handling, shipping, transit, or delivery timeframe displayed on the Website is an estimate unless we expressly state otherwise.

Estimated delivery dates are not guaranteed.

Once a shipment has been transferred to a shipping carrier, delivery is performed by the carrier and may be affected by circumstances outside ScentsGift's control, including:

  • Weather;
  • Natural disasters;
  • Carrier delays;
  • Transportation disruptions;
  • Holidays;
  • Customs processing;
  • Government actions;
  • Incorrect routing;
  • Security inspections;
  • Labor disruptions; or
  • Other events beyond our reasonable control.

ScentsGift is not liable for carrier delays or failure to meet estimated delivery dates except where required by applicable law.

13. Tracking and Delivery Confirmation

Tracking information is provided as a convenience and may not update immediately after a shipment is transferred to the carrier.

Carrier tracking records are generally relied upon when determining shipment status.

If a carrier marks a shipment as delivered but the customer cannot locate it, the customer should promptly:

  • Check the delivery location;
  • Check with household members;
  • Check mailboxes, parcel lockers, reception desks, leasing offices, or neighbors where appropriate; and
  • Contact the shipping carrier.

ScentsGift may assist with carrier inquiries where reasonably possible but does not control carrier delivery operations.

To the maximum extent permitted by applicable law, ScentsGift is not responsible for theft, loss, disappearance, or damage occurring after a shipment has been confirmed as delivered to the shipping address supplied by the customer.

14. Package Protection

ScentsGift may offer optional third-party package protection, including protection against certain lost, stolen, or damaged shipments.

Package protection is governed by the terms, eligibility requirements, exclusions, deadlines, and claims procedures of the applicable protection provider.

Purchasing package protection does not guarantee approval of a claim.

Customers who purchase package protection may be required to submit claims directly through the protection provider.

Failure to purchase optional package protection does not create additional liability for ScentsGift beyond what is required by applicable law.

15. International and Canadian Shipments

Customers receiving shipments outside the United States are responsible for complying with the import laws and regulations of the destination country.

Unless expressly stated otherwise, the recipient is responsible for all:

  • Customs duties;
  • Import taxes;
  • Brokerage charges;
  • Government fees;
  • Carrier collection charges; and
  • Other costs imposed after shipment.

These charges are not included in the product purchase price unless expressly stated.

Refusal or failure to pay customs duties, taxes, brokerage fees, or other import charges may result in the shipment being delayed, returned, abandoned, or destroyed by the carrier or customs authority.

ScentsGift is not responsible for losses or expenses arising from a customer's failure to satisfy import requirements or pay applicable charges, except where required by law.

If a shipment is returned to ScentsGift, any refund or reshipment eligibility will be determined according to our applicable policies, and shipping, return, customs, brokerage, or other charges incurred may be deducted where permitted by law.

16. Signature and Identity Verification

For fraud prevention, payment security, or shipment protection, ScentsGift may require additional verification before fulfilling an order.

Verification may include confirming:

  • Billing information;
  • Shipping information;
  • Recipient identity;
  • Payment authorization; or
  • Other information reasonably necessary to verify the transaction.

We may also require a carrier signature for certain shipments.

Failure or refusal to complete requested verification may result in the order being placed on hold or canceled.

17. Pricing and Product Errors

We make reasonable efforts to ensure that product descriptions, pricing, availability, quantities, images, and other information are accurate.

However, errors may occasionally occur.

We reserve the right to correct pricing, typographical, inventory, product-description, technical, or other errors at any time.

If an order contains an obvious pricing or listing error, we may cancel the affected order or item and refund the corresponding amount.

18. Payments

Payment must be made through a payment method offered at checkout.

By submitting payment information, you represent and warrant that:

  1. You are authorized to use the payment method;
  2. The payment information you provide is accurate; and
  3. You authorize us and our payment processors to process charges associated with your order.

Payment transactions may be processed by third-party payment providers and are subject to their applicable terms and security procedures.

19. Chargebacks and Payment Disputes

If you believe there is a problem with an order, we encourage you to contact ScentsGift at info@scentsgift.com before initiating a payment dispute so that we have an opportunity to investigate and resolve the matter.

Initiating a chargeback does not automatically entitle a customer to retain merchandise without payment.

ScentsGift reserves the right to provide payment processors, card networks, financial institutions, insurers, fraud-prevention services, carriers, or other appropriate parties with relevant transaction documentation when responding to a payment dispute.

Such documentation may include order records, communications, IP or device information where lawfully collected, shipping records, delivery confirmations, photographs, verification records, policy acceptance records, and other evidence relating to the transaction.

Fraudulent, knowingly false, or abusive payment disputes may result in cancellation of future orders or restriction from using the Website, in addition to any other remedies available under applicable law.

20. Product Safety and Allergies

Fragrance products may contain alcohol, fragrance compounds, essential oils, allergens, or other ingredients that may cause sensitivity or irritation in some individuals.

Customers are responsible for reviewing manufacturer ingredient information where available and determining whether a product is appropriate for their own use.

Discontinue use if irritation or an adverse reaction occurs.

ScentsGift does not provide medical advice.

Customers with allergies, sensitivities, medical concerns, or questions regarding ingredients should consult an appropriate healthcare professional or the fragrance manufacturer before use.

21. Proper Use

Fragrance products are intended for normal personal fragrance use unless otherwise indicated.

You agree not to intentionally misuse products purchased from ScentsGift.

Keep fragrance products away from flames, excessive heat, and other ignition sources where appropriate.

Keep products out of reach of young children and pets.

22. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You agree to provide accurate and current information.

We reserve the right to suspend or terminate accounts involved in fraud, abuse, unlawful activity, policy violations, or conduct that threatens the security or operation of the Website.

23. Prohibited Uses

You may not use the Website:

  • For unlawful or fraudulent purposes;
  • To impersonate another person;
  • To submit false payment information;
  • To interfere with Website security;
  • To transmit malware or harmful code;
  • To scrape or systematically extract Website content without permission;
  • To infringe intellectual-property rights;
  • To attempt unauthorized access to our systems; or
  • To engage in conduct that materially interferes with the Website or other customers.

We may restrict or terminate access for violations of this section.

24. Intellectual Property

The Website and its original content, design, graphics, photographs, text, logos, layout, software, and other materials created by ScentsGift are owned by or licensed to SWEX LLC and are protected by applicable intellectual-property laws.

You may use the Website solely for personal, non-commercial shopping purposes.

No ScentsGift-owned content may be reproduced, republished, distributed, sold, modified, or commercially exploited without prior written permission.

Third-party trademarks and intellectual property remain the property of their respective owners.

25. Third-Party Services and Links

The Website may contain links to or integrations with third-party websites, payment processors, shipping carriers, package-protection companies, applications, or other services.

ScentsGift does not control those third parties and is not responsible for their content, availability, policies, security, acts, or omissions.

Your interactions with a third party may be governed by that third party's own terms and policies.

26. Website Availability

We do not guarantee that the Website will always be available, uninterrupted, secure, error-free, or free of harmful components.

We may modify, suspend, restrict, or discontinue any portion of the Website at any time.

27. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

SCENTSGIFT DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

NOTHING IN THESE TERMS EXCLUDES ANY WARRANTY OR CONSUMER PROTECTION THAT CANNOT LEGALLY BE EXCLUDED.

28. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWEX LLC, SCENTSGIFT, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO:

  • Use of the Website;
  • Inability to use the Website;
  • Purchase or use of a product;
  • Carrier delay;
  • Lost or stolen shipments;
  • Third-party conduct;
  • Customs actions;
  • Website interruption;
  • Data loss; or
  • Other matters relating to the Website or an order.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCENTSGIFT'S TOTAL AGGREGATE LIABILITY ARISING FROM A PARTICULAR ORDER SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO SCENTSGIFT FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.

In such cases, liability will be limited to the maximum extent permitted by applicable law.

29. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless SWEX LLC, ScentsGift, and their officers, employees, contractors, agents, and affiliates from claims, liabilities, damages, losses, and reasonable costs arising out of your:

  • Unlawful use of the Website;
  • Violation of these Terms;
  • Fraudulent conduct;
  • Infringement of another person's rights; or
  • Intentional misuse of products or services.

This provision does not require a consumer to indemnify ScentsGift for ScentsGift's own unlawful conduct, negligence, or obligations that cannot legally be transferred to the consumer.

30. Force Majeure

ScentsGift will not be responsible for delay or failure to perform caused by events reasonably outside our control, including:

  • Natural disasters;
  • Severe weather;
  • Fire;
  • Flood;
  • Power outages;
  • Internet or telecommunications failures;
  • Labor disruptions;
  • Carrier disruptions;
  • Government actions;
  • Customs actions;
  • War;
  • Civil disturbances;
  • Epidemics or public-health emergencies;
  • Supply-chain interruptions; or
  • Similar circumstances beyond our reasonable control.

31. Governing Law

These Terms and any dispute arising from your use of the Website or purchase from ScentsGift will be governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

32. Dispute Resolution

Before filing a legal claim relating to an order or the Website, you agree to make a reasonable good-faith effort to resolve the dispute directly with ScentsGift by contacting:

Nothing in this section prevents either party from exercising rights that cannot legally be waived.

To the extent legally permitted, any judicial proceeding arising from these Terms or a transaction with ScentsGift shall be brought in a state or federal court having proper jurisdiction in Texas.

33. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent legally permissible, and the remaining provisions will continue in full force and effect.

34. No Waiver

Failure by ScentsGift to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

35. Entire Agreement

These Terms, together with the policies incorporated into them by reference, constitute the agreement between you and ScentsGift concerning your use of the Website and purchases made through the Website.

If a specific ScentsGift policy expressly conflicts with these Terms regarding a particular subject, the more specific policy will govern that subject unless prohibited by applicable law.

36. Changes to These Terms

We may modify these Terms from time to time.

The current version will be posted on the Website with an updated "Last Updated" date.

Changes will apply prospectively from their effective date unless otherwise required by law.

Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
